Terms of Service

Welcome to LunarWerx LLC. These Terms of Service ("Terms") form a binding agreement between you and LunarWerx LLC, a Missouri limited liability company ("LunarWerx", "we", "us", or "our") and govern your access to and use of our website at https://lunarwerx.com, our interactive features, and our products and applications that reference these Terms. Please read them carefully. Last updated: October 7, 2026.

1. Acceptance of the Terms

By accessing or using the LunarWerx website or any LunarWerx product or application that references these Terms (collectively, the "Services"), you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.

If you do not agree to these Terms, do not access or use the Services.

2. About LunarWerx & Scope of these Terms

LunarWerx is a remote-first digital studio operated by LunarWerx LLC, a Missouri limited liability company. We build and operate our own products and applications. We do not provide client services or take on client work.

These Terms are the master, company-level terms for LunarWerx. They apply to:

  • The marketing website at lunarwerx.com;
  • LunarWerx products and applications that incorporate these Terms by reference. For example, the mobile app Side Quest, published by LunarWerx, uses these Terms of Service as its reference legal terms.

Where a specific product or application has its own supplemental terms, those supplemental terms apply to that product or application in addition to these Terms. If there is a direct conflict, the supplemental terms control for that specific product or application. Current supplemental terms: SideQuest Terms of Service.

3. Eligibility

You must be old enough to form a binding contract in your jurisdiction (in most U.S. states, 18). If you are a minor, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at contact@lunarwerx.com so we can take appropriate action.

4. Accounts & Registration

Some LunarWerx products or applications may offer accounts. Where an account is offered and you choose to create one, you agree to:

  • Provide accurate, current, and complete information, and keep it up to date;
  • Keep your login credentials confidential and secure;
  • Take responsibility for all activity that occurs under your account.

You must notify us promptly at contact@lunarwerx.com if you suspect any unauthorized use of your account. We are not liable for losses arising from your failure to safeguard your credentials. This section applies only where an account is actually offered as part of a Service.

5. AI Features

Some LunarWerx products use artificial intelligence to generate output.

  • Not advice. AI output is not professional, legal, financial, technical, or business advice, and you should not rely on it as such.
  • Output may be inaccurate. Output is auto-generated and may be incomplete, inaccurate, outdated, or otherwise unsuitable. You are solely responsible for evaluating and verifying any output before relying on it.
  • Your reliance is at your own risk. You are solely responsible for any decision or action you take based on AI output, and we are not liable for any loss or damage arising from your reliance on it.
  • Do not submit sensitive data. Do not submit any unlawful, sensitive, confidential, or personally identifying information through any AI feature. Do not submit anything you are not authorized to share.
  • Third-party processing. AI features may send text through a Cloudflare Worker to a third-party AI provider, such as Google's Gemini API, to generate the output. That processing is subject to the provider's applicable terms. No AI API keys are exposed in your browser.
  • Ownership and rights in AI output. We make no representation that AI output is unique, original, accurate, or free of third-party rights; similar or identical output may be generated for other users. To the extent we hold any rights in AI output provided to you, we grant you a non-exclusive license to use it for your own purposes, subject to these Terms and Google's terms. We make no intellectual property ownership or non-infringement warranty for AI output.

We may change, limit, suspend, or discontinue any AI feature at any time without notice.

6. Payments, Subscriptions & Refunds

Certain LunarWerx products or applications may be offered for a fee or on a subscription basis. Where you make a purchase:

  • Authorization to charge. You authorize us, or our payment processor, to charge the payment method you provide for all applicable fees, including recurring charges.
  • Renewals. Subscriptions renew automatically for successive periods until cancelled, unless stated otherwise at purchase. You may cancel future renewals as described in the relevant product or app store.
  • Taxes. Stated prices may exclude applicable taxes, which you are responsible for paying.
  • Refunds. Except where required by law or stated otherwise at purchase, fees are non-refundable. Where we do issue a refund for a product billed directly, it will be processed through our payment processor (for example, Stripe). Purchases made through an app store are subject to that store's billing and refund policies, and refunds for those purchases must be requested through the store.

Payments for paid products may be processed by Stripe, and certain products may run on Amazon Web Services infrastructure. These processors do not apply to the marketing website; they apply only where expressly used by a paid product or application.

7. App Store Terms

Where you obtain or use a LunarWerx application through a third-party app store, such as the Apple App Store or Google Play, the following additional terms apply to your licensed use of that application:

  • These Terms are an agreement between you and LunarWerx only, and not with Apple or Google. LunarWerx, not the store provider, is solely responsible for the application and its content.
  • The store providers have no obligation whatsoever to furnish any maintenance or support services for the application.
  • The store providers are not responsible for addressing any claims relating to the application or your use of it, including product liability claims, claims that the application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or intellectual property law.
  • Apple, Apple's subsidiaries, and Google are third-party beneficiaries of these Terms and have the right to enforce these Terms against you as they relate to your licensed use of the application.
  • Your use of the application is also subject to the applicable store's Terms of Service and Usage Rules.

8. Acceptable Use

You agree not to, and not to permit anyone else to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose;
  • Reverse engineer, decompile, or attempt to extract the source code of any Service, except where permitted by law;
  • Scrape, harvest, or use automated means to access the Services in a way that burdens our infrastructure or violates these Terms;
  • Upload or transmit malware, viruses, or any malicious code;
  • Infringe the intellectual property, privacy, or other rights of any person;
  • Harass, abuse, threaten, or defame others;
  • Probe, scan, or interfere with the integrity, security, or performance of the Services, or attempt to gain unauthorized access to any system or data.

9. User Content & License

"User Content" means any content you submit through the Services, such as messages you send us or text you enter into a product. You retain ownership of your User Content.

You grant LunarWerx a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your User Content solely as necessary to operate, provide, secure, and improve the Services and to respond to you. For features that rely on third-party AI providers, you authorize us to transmit your User Content to those providers (for example, Google's Gemini API) solely to generate and return output to you, as described in Section 5 and our Privacy Policy. You are solely responsible for your User Content and represent that you have the rights to submit it and that it does not violate these Terms or any law.

10. Intellectual Property

The Services, including the website, the LunarWerx and Side Quest names, logos, branding, designs, text, graphics, and underlying software, are owned by LunarWerx or our licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for their intended purpose.

Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from any part of the Services without our prior written consent. All rights not expressly granted are reserved.

11. Third-Party Services & Links

The Services rely on and may link to third-party services and websites, including Google (Gemini API), Cloudflare, Resend, Stripe, Amazon Web Services, and app stores. We do not control and are not responsible for the content, policies, availability, or practices of any third party. Your use of a third-party service is governed by that party's own terms and privacy policy, and we encourage you to review them.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy, which explains what we collect, how we use it, the third-party sub-processors we use, and the privacy rights available to you. By using the Services, you acknowledge the practices described in the Privacy Policy.

13. Disclaimers

To the fullest extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any output, including AI output, will be accurate or reliable. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

14. Limitation of Liability

To the fullest extent permitted by law, LunarWerx and its affiliates, officers, employees, contractors, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or related to your use of, or inability to use, the Services, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid to LunarWerx for the Service giving rise to the claim in the twelve (12) months before the event, or (b) one hundred U.S. dollars (USD $100). Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless LunarWerx and its affiliates, officers, employees, contractors, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to: (a) your misuse of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

16. Termination & Suspension

You may stop using the Services at any time. We may suspend or terminate your access to the Services, in whole or in part, at any time, with or without notice, including if we reasonably believe you have violated these Terms or to protect the Services, other users, or third parties.

Upon termination, your right to use the Services ceases. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive.

17. Changes to the Services and to these Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time. When we make changes, we will update the "Last updated" date above. For material changes, we will provide reasonable notice, such as by posting on the website or through another appropriate channel. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that proceeds in court will be the state or federal courts located in Missouri, and you consent to their jurisdiction.

Before filing any claim, you agree to first try to resolve the dispute informally by contacting us at contact@lunarwerx.com. We will attempt to resolve the matter in good faith. If we cannot resolve it within a reasonable period, either party may pursue available remedies consistent with this section.

To the extent permitted by law, any claim arising out of or related to the Services must be brought within one (1) year after the claim arose, or it is permanently barred.

19. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and any applicable supplemental terms, are the entire agreement between you and LunarWerx regarding the Services.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices. Legal notices to LunarWerx should be sent to contact@lunarwerx.com. Copyright notices are the exception: those go to our designated agent at copyright@lunarwerx.com, the address registered with the United States Copyright Office. See our DMCA and Copyright page.
